Official Fan Club Membership Terms and Conditions
Article 1 (General Provisions)
These terms and conditions apply to all use of MFC services by persons who have accepted the contents of these terms and conditions, completed the membership procedure using the application method specified by the Company, and whose membership in MFC has been approved by the Company ( hereinafter referred to as a "Member" ) , as well as to applications for membership by those wishing to join, in relation to MFC operated by Zowie Inc. (hereinafter referred to as "the Company" ) , which has obtained a license to operate the "Moomin Official Fan Club" (hereinafter referred to as " MFC ") from Rights and Brands Inc. (hereinafter referred to as "RBJ"), which manages Moomin licenses in Japan and distributes the videos of the TV animation "Moominvalley."
Article 2 (Scope of Application of These Terms)
1. If there are any other terms of use, etc. ( hereinafter referred to as "Terms of Use, etc." ) stipulated separately in addition to these Terms in the operation of the MFC by the Company , they shall be deemed to constitute a part of these Terms, regardless of their purpose.
2. In the event that there is a discrepancy between the provisions of these Terms and the provisions of the Terms of Use, etc. set forth in the preceding paragraph, the provisions of the Terms of Use, etc. shall take precedence.
Article 3 (Members)
We use the personal information of customers we acquire for the following purposes, and to the extent necessary to achieve those purposes. If it becomes necessary to change the purpose of use, we will notify customers or make an announcement to that effect.
- When an applicant completes registration in the member system for MFC membership registration (hereinafter referred to as the "member system"), the Company will approve the applicant's registration. In addition, when registering in the member system, the applicant must agree to RBJ 's privacy policy and the Company 's privacy policy.
- Minors must obtain prior consent from their legal guardian regarding the enrollment procedures and use of various MFC services after enrollment. When a minor applies for membership with our company , MFCJ will assume that prior consent has been obtained from the legal guardian, carry out the various procedures, and will not be held responsible for any unforeseen circumstances that may arise in connection with this.
- MFC is only available to those who reside in Japan, and those who reside outside of Japan cannot become members. If a member moves outside of Japan after joining, he/she must immediately withdraw from the membership. Furthermore, if the Company becomes aware of this fact, the member will be forced to withdraw from the membership.
- Applicants for membership and their legal representatives must review and accept all of the contents of these terms and conditions before proceeding with the membership application process.
- Each member may only register one account. One email address is required for each account.
Article 4 (Notification from the Company to Members)
The Company will notify the Member of any necessary information in a timely manner by displaying the information within the System, the Member's email address registered in the System, or by any other method that the Company deems appropriate. However, if a notification is sent by email or other method based on the Member's information but does not reach the Member for any reason, the notification will be deemed to have been sent by the Company at the time that it would normally be received.
Article 5 (Changes to Terms and Services)
1. The Company may change these Terms and Conditions and the Terms of Use, etc. ( hereinafter referred to as the "Terms, etc." ) as well as the member benefits and services, etc. based thereon ( hereinafter referred to as the "Services," including all the various member benefits ) without prior notice or consent to the Member in the following cases.
( 1 ) When it is in the general interest of some or all users.
( 2 ) When the change is reasonable in light of the necessity for the change, the appropriateness of the content after the change, the content of the change, and other circumstances related to the change.
( 3 ) When the Company determines that a review of the Service is necessary for the operation of MFC or the maintenance and improvement of the Moomin brand.
2. If the Company changes these Terms and Conditions, etc., it will determine the effective date and notify Members by email of the fact that the Terms and Conditions, etc. are being changed, the content of the changed Terms and Conditions, etc., and their effective date.
3. If the Company makes any changes to the Service, the Company will not provide prior notice to or confirm the Members' intentions.
4. Changes to these Terms and Conditions and the Service shall take effect from the time they are displayed on the official website or within the System, unless otherwise specified by the Company .
Article 6 (Types of Members)
There are two types of membership: free membership and paid membership.
Article 7 (Member Benefits)

The specific details of MFC member benefits and services will be determined separately by the Company.
2. MFC 's membership benefits and services are subject to change at irregular intervals, and members will not be notified or asked to confirm their intentions.
3. For any reason, including cases where emails or other mailings do not reach the Member due to circumstances on the Member's part or circumstances on the Member's contracted communications company or delivery service company, the Company will not extend the acceptance period or take any other action regarding the benefits of this Service. - The update frequency of each content displayed on the site for this service is merely a guideline, and we do not guarantee that the content will be updated. Content updates may be suspended during the New Year holidays, national holidays, etc. Furthermore, the use of "back issues" or similar expressions does not guarantee that all content provided in the past will be provided.
Article 8 (Membership Period)
- If the Service has not been used for more than three years since the last date of use, your free membership may be terminated and your account and personal information may be deleted.
- The validity period of a paid membership is one year from the date of renewal of the paid membership . (Example) Renewal on May 10th → Until May 9th of the following year
Article 9 (Membership Fees)
1. Membership fees for free members are free.
2.Membership fees for paid members are paid annually ( once a year, at the time of joining and at the time of renewal).
3.Paid members will pay the specified annual membership fee to the Company in the specified manner.
4.The Company will not refund annual membership fees received to members for any reason, except in cases where a refund is expressly provided for in these regulations.
5. Membership fees can only be paid by credit card.
Article 10 (Continuation of Paid Membership)
- Paid membership will be automatically renewed and will continue into the following year unless the member indicates their intention to terminate their membership by the deadline specified by the Company in a manner designated by the Company.
- The renewal fee for paid members will be charged on the day after the contract expiration date. (Example) If the expiration date is December 31st , the renewal fee will be charged on December 30th .
- The deadline for expressing your intention to terminate your paid membership (the deadline for expressing your intention to end your paid membership upon the expiration of the validity period) is one day before the contract expiration date. (Example) If the expiration date is April 30th , the deadline is April 29th .
- To express your intention to terminate your paid membership (express your intention to stop being a paid membership when the validity period expires), you must complete the specified procedure on your My Page at least one day prior to the expiration of your contract, and after completing the procedure, you will become a free member when the validity period of your paid membership expires.
- We will inform you of the extension of the usage period by email to the email address specified by the customer one month before the expiration of the usage period . Members should be careful to change their email address, etc.
- A paid member may immediately indicate his/her intention to terminate his/her paid membership by completing the prescribed procedure on his/her My Page. In this case, after completing the procedure, the member will lose his/her paid membership status and become a free member.
- Even if you do not indicate your intention to terminate your paid membership, if you are unable to make a credit card payment by the due date, you will become a free member after the expiration date.
- If you lose your paid membership, any data from the paid membership services that is not included in the free membership services will be deleted.
- Even if a paid member dies, if the Company receives notice of the death after the paid membership renewal procedure has been completed, the annual membership fee will not be refunded.
Article 11 (Prohibition of Transfer, etc.)
Members may not lend, transfer or sell the Service (membership benefits, services, points, etc.) or their membership status to a third party, and may not grant consent to use or change the name, establish a pledge on or otherwise use it as collateral.
Article 12 (Withdrawal)
1. To cancel your membership, a paid member must quit their paid membership and become a free member.
2. Free members may cancel their membership by following the prescribed procedures. Upon canceling their membership, members will lose all rights to MFC -related member services and benefits, and such data will be completely deleted after a certain period of time by our deletion procedures.
Article 13 (Refusal of admission, cancellation of membership)
1. If an applicant or member falls under any of the following items, our company may, without prior notice or warning, refuse the application of the applicant or cancel the membership of the member or have him/her withdraw from the company.
( 1 ) If the registered member information is false (such as information about a non-existent person or someone else, excluding input errors, etc.)
( 2 ) If you allow a third party to use this service.
( 3 ) If merchandise, tickets, information, etc. intended for members that were obtained by using the membership qualifications or rights is provided free of charge or sold for a fee to a non-member or other member or other third party.
( 4 ) If the Company determines that the individual is a member, constituent member, or related party of a so-called organized crime group or a similar anti-social group ( hereinafter referred to as a "Member of an Organized Crime Group, etc." ) , or if the Company determines that five years have not yet passed since the individual ceased to be a Member of an Organized Crime Group, etc.
( 5 ) If you make unauthorized use of the System or fail to comply with notices from the Company or MFC to improve your use of the System.
( 6 ) If membership fees are not paid by the due date.
( 7 ) If you have been denied membership or forced to leave the club in the past.
( 8 ) If a minor completes the membership procedure without obtaining the consent of a legal guardian.
( 9 ) When a member dies.
( 10 ) If you are a resident outside Japan.
( 11 ) If you violate any provision of these Terms and Conditions.
( 12 ) Any other reason that the Company determines to be unsuitable for membership.
2. If a member is deemed to have engaged in an act that warrants "withdrawal," "refusal to enroll," "cancellation of membership," etc., the Company may suspend provision of all or part of the Service to the member until an investigation into the facts is completed.
Article 14 (Principle of self-responsibility)
1. Members shall be solely responsible for any actions taken using MFC 's activities and this Service, as well as the consequences thereof, and shall not cause any inconvenience or damage to the Company , MFC or the Moomin brand.
2. If a Member causes damage to a third party or if a dispute arises between a Member and a third party in connection with MFC 's activities or the use of the Service, the Member shall resolve such at his/her own responsibility and expense, and neither the Company nor MFC shall be held liable.
3. If a Member has any request, question or complaint regarding the actions of another person, the Member shall notify that person directly and shall deal with and resolve any resulting issues at the Member's own responsibility and expense.
4. The Company shall not be liable for any damages incurred by the Member due to the activities of MFC and the use of the Service, and shall be exempt from any obligation to pay damages if the Member suffers damages from a third party other than the Company in connection with the use of the Service, etc. However, this does not apply to damages caused by reasons that are legally recognized as attributable to the Company .
Article 15 (Other Prohibited Matters)
1. Any action that infringes or may infringe the intellectual property rights, such as copyrights and trademarks, of the Company , MFC , or any third party
2. Any act that infringes or may infringe the property, privacy, or portrait rights of a third party
3. Any act that libels or slanders the Company or a third party, or damages the reputation or credibility of the Company or a third party
4. Any act that causes or may cause detriment to the Company or a third party
5. Any action that interferes with the operation of MFC
6. Any act that violates or may violate these Terms and Conditions, the Terms of Use, laws, regulations, or public order and morals
7. Any other conduct that the Company deems inappropriate
Article 16 (Disclaimer)
1. If the Company 's business operations and MFC 's Services, etc. are suspended due to any of the reasons set out in the following items, the Company shall not be liable therefor.
( 1 ) In the event of force majeure such as a natural disaster
( 2 ) When there is a reason attributable to a telecommunications company, electricity supplier, delivery company, card payment agency, or other contractor of our company.
( 3 ) When there are circumstances that cannot be directly recognized by the Company or its contractors, such as malfunctions of software or hardware.
( 4 ) In the case of system maintenance and inspection
( 5 ) When the reason is due to the member’s circumstances
( 6 ) Other unavoidable circumstances
Article 17 (Termination and Dissolution of this Fan Club)
1. The Company may, at its discretion , terminate MFC and discontinue provision of the Service by notifying Members in advance.
2. In the case of the preceding paragraph, the Company shall not be liable or obligated to pay compensation for any damages incurred by a Member or a third party as a result of the use of MFC and the Service.
3. In the case of paragraph 1 , the Company shall refund to paid members a portion of the annual membership fee, as separately specified, in the following proportions according to the validity period of the paid membership , or provide an equivalent amount in kind .
Remaining paid membership period: 0 yen for less than 2 months, 160 yen per month for 3 months or more
4. The remaining paid membership validity period shall be the remaining period at the time the paid membership service ends.
Article 18 (Governing Law)
The establishment, validity, performance and interpretation of these Terms and Conditions shall be governed by Japanese law.
Article 19 (Exclusive jurisdiction)
In the event that litigation arises between the Company and a Member regarding these Terms, the Terms of Use, or the Service, the Tokyo District Court or the Tokyo Summary Court shall be the exclusive court of first instance.
